1. A $50 credit card check will verify you are registering with a valid credit card. This is not a charge. No funds will be taken and there is no charge required to register to bid. You must be registered in order to bid.

2. All items are sold 'As is- Where is', and according to the Federal Uniform Commercial Code (UCC 2-238) At the electronic closing of each auction item there is a legally binding contract for the purchase of the item.  Not every item will have detailed description or information regarding condition. As a bidder and buyer it is your responsibility to determine if the items is in a condition you wish to purchase. No returns are permitted due to buyers remorse, or similar reasons. Damage and condition should be sufficiently documented in the photos of the items being sold. If there is clear difference in condition between the photos and the actual items at the time of pick up, Malama Auctions will issue a refund full or in part on a case-by-case basis. Any items that you buy that are not functional or do not work as indicated Malama Auctions will accept a return/refund. It is not our policy to sell non functional items, however at times we are unable to test items before offered for sale. Due to the timeliness of paying the sellers, we require all return or refund requests must be made within 7 calendar days of the auction in writing. Please send requests to info@malamaauctions.com.

3. Credit Card is the only accepted method of payment. The card you have used to register your account will be automatically charged after the completion of the auction and before pick up for any relevant invoice(s). If for any reason payment is unable to be processed with this card your account will be suspended. To reinstate your account, full payment for your outstanding invoice, and any other applicable charges or fees must be paid. There may be a $10 service charge to reinstate your account if your previous invoices have not been collected.

4. Anyone caught tampering with tags, merchandise, or shoplifting will be prosecuted to the fullest extent possible.

5. Buyers are responsible for the moving, packing, boxing, and loading of all items purchased. This means providing your own truck, packing materials, boxes, bags, straps, rope etc., and labor/help to load your own vehicle. On typical, or fully managed auctions, Malama Auctions staff will be onsite to assist in locating and providing you the items you have purchased. Assistance loading your vehicle cannot be ensured, but when available it will be provided as requested on a first come first served basis. On collaborated Auctions, no Malama Auctions staff will be on site, and no assistance for moving or loading is offered. Please ensure you have the help you need when you arrive on site for pick up.  

6. In an attempt to provide the most transparent acquisition of items sold by our clients at auction, Malama Auctions staff reserve the right to bid on and purchase merchandise from the auction.

7. By bidding in this auction, you agree to pick up your items at the specific times stated above per the Terms and Conditions unless you have made specific arrangements with Malama Auctions prior to the conclusion of the auction. By 3pm on January 29th your items will be considered forfeited and may be sold again at a future sale, discarded or otherwise disposed of based on Malama Auctions and/or the sellers discretion. Anyone who does not pick up their items without communicating with Malama Auctions staff will have their account discontinued. As mentioned above in term #2, the purchase of all items is required by contract, even if you have not acquired your items. If you wish to willingly forfeit the items you have purchased, please let Malama Auctions staff know when an inquiry is made of you regarding your scheduled pick up time and your account will stay active with no penalties.

8. There is a 23% buyers premium added to the hammer price of all lots. This surcharge goes to partial compensation to the auction company for services rendered to the buyers that include, but are not limited to invoicing, scheduling, coordination of pick up and cataloged information.

9. All of our online-only auctions are conducted using staggered closing times. That means every minute a select number of lots will close. The closing of an item is defined by the scheduled time that bidding should end on that particular lot. This auction is scheduled to close 10 lots per minute. A count down timer is indicated on each lot in the auction.

 10. All of our online-only auctions are conducted using a soft close. This means that even if an item is scheduled to close at a particular time, if someone places a bid in the last two minutes, a two-minute count down timer will reset to the scheduled close time for that particular lot. The count down timer will continue to reset every time a bid is placed until there are at least two minutes with no additional bids.
